Video Content terms and conditions

 

This Online Connect IT web site (the "Site") is owned and operated by UK Online Limited ("UK Online") a company registered in England and Wales, with company number 02968652 and registered office address at 44-46 Whitfield Street, London W1T 2RJ.

UK Online Limited is a subsidiary of British Sky Broadcasting Group plc, a company registered in England and Wales with company number 2247735 and registered office address at Grant Way, Isleworth, Middlesex TW7 5QD.

By submitting your video content to UK Online, you shall be deemed to have accepted these Video Content terms and conditions in full including the Terms and Conditions for Online Connect IT website (collectively referred to as ‘these terms and conditions’) regardless of whether or not your video content appears on the Site.

The Site can only be used by you for your personal, non-commercial use.

By uploading your video, you will be deemed to have accepted and be bound by these terms and conditions.

UK Online may change these terms and conditions from time to time and so you should check these regularly. Your use of the Site will be deemed an acceptance of the terms existing at that time. These terms and conditions as may be amended from time to time apply to each visit to the Site, both now and in the future.

  1. Usage
    By submitting your video content to UK Online or by uploading any video content to the Site you warrant to us that:-

    (a) You are the sole creator and owner of the video content and have full rights to upload it onto the Site; and

    (b) You, and any persons appearing in your video content are over 18 years old and each such person has given you their full permission for you to publish the video content on the Site; and

    (c) The video content does not contain any third party copyright material (for example music and video footage which you have not created yourself); and

    (d) The video content does not contain any software virus, computer code or other matter which may interfere with any system in any way whatsoever; and

    (e) You shall only use the Site in accordance with these terms and conditions on the Site and shall not in any way attempt to circumvent any restrictions in the Site; and

    (f) The video content shall not nor attempt to advertise, promote or endorse any products or services; and

    (g) Nothing in the video content is unlawful, offensive, threatening, abusive, obscene or defamatory or in breach of any of these terms and conditions or any applicable law or regulation; and

    (h) you shall ensure that the video content complies at all times with UK Online’s Acceptable Use Policy; and

    (i) The video content does not contain any software virus, computer code or other matter which may interfere with any system in any way whatsoever.

  2. Removal of material
    We retain the right at our sole discretion not to show any video on the Site which in our reasonable opinion has not complied with these terms and conditions together with the right to remove any such video from the Site at any time, and without notice.

  3. Licence
    You grant us a worldwide, non-exclusive, royalty-free, sub-licensable and transferable licence to use, reproduce, distribute, perform and make derivative works of your video content in any media and through any media channel, including the right to make your video available for download.

  4. Conditions of video content
    It is not guaranteed that uploading your video will ensure its appearance on the channel.

    Your video must be your own original work and your sole and exclusive property. You also warrant that you own or control all of the rights to your video, including any music, video clips or photographs featured within it.

    You must not upload material that is unlawful, offensive, obscene, defamatory, discriminatory, threatening, pornographic, harassing, hateful or racist, or encourages dangerous, irresponsible, anti-social or criminal behaviour.

    Offensive swear words in the video content will be starred out, and, in some cases, be completely removed. If your video footage includes very offensive swear words, it will not be shown on the site.

    Illegal acts will not be shown whether your footage shows it or condones it. This could include underage drinking, drug taking or condoning acts of terrorism. Footage that depicts violent or dangerous behaviour will not be shown, such as 'happy-slapping'

    Any material that could easily be copied by people (especially very young children) that could cause them either physical or mental harm will not be shown.

  5. Liability
    By uploading your video to Online Connect IT, you agree to release, discharge and hold us harmless from any and all injuries, liability, losses and damages of any kind resulting from the creation or uploading of your video content save that nothing shall limit our liability for fraud, or for death or personal injury caused by our negligence).

    If you submit a video that includes material the rights in which are owned by a third party, including intellectual property rights such as copyright and trademarks, you will be responsible for any legal action that party may take against you.

    You agree to indemnify UK Online and/or any of UK Online’s affiliates and its officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of the Site.

    In the case of any violation of these terms and conditions, UK Online reserves the right to seek all remedies available by law and in equity for such violations.

    No responsibility is accepted by UK Online for any network, hardware or software failure or error of any kind.

    In no event will UK Online or any of its subsidiaries or their parent companies be liable to you for any direct, special, indirect, consequential, incidental damages or any damages of any kind even if UK Online has been advised of the possibility thereof. (Applicable law may not allow the limitation or exclusion of liability for consequential or incidental damages, so the limitation or exclusion may not apply to you.)

    UK Online will be liable for any fraudulent misrepresentations UK Online makes and for any death or personal injury caused by UK Online’s negligence. To the extent permitted by law, UK Online shall not be responsible or liable to you for any other loss or damage that you or any third party may suffer as a result of using or in connection with your use of the Site.

  6. Privacy of Data
    Certain areas of the Site allow for the exchange of information between you and UK Online and by providing that information you grant UK Online the authority and right to use that information in accordance with the UK Online Privacy Policy. Insert link

  7. Severance
    If any part of these terms and conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the terms and conditions and shall not affect the validity and enforceability of any of the remaining provisions of the terms and conditions.

  8. Waiver
    No waiver by UK Online shall be construed as a waiver of any proceeding or succeeding breach of any provision.

  9. Survival
    Each provision of the terms and conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

  10. Governing Law
    The Site is not directed at any person in any jurisdiction where for any reason the publication or availability of the Site is prohibited. Those in respect of whom such prohibitions apply must not access the Site.

    UK Online does not represent that any of the materials or information at the Site are appropriate for use or permitted by local laws in all jurisdictions. Those who access the Site do so by their own initiative and are responsible for compliance with applicable laws and regulations. Legal advice should be sought in cases of doubt.

    The terms and conditions are governed by and shall be construed in accordance with the laws of England and Wales and you and UK Online agree to submit to the exclusive jurisdiction of the English courts.

  11. Third Party Rights
    These terms and conditions apply between you and UK Online. No other person or company (apart from companies within the British Sky Broadcasting Group plc group of companies) is entitled to benefit under or to enforce these terms and conditions.
